Order unanimously reversed, without costs, and motion denied. Memorandum: Claimants were injured on August 12, 1974 when their vehicle collided with an automobile which was being towed by an automobile owned by the State. Due to their attorneys lack of knowledge concerning the filing requirements of the Court of Claims Act, no claim or intention to file a claim against the State was filed within the 90-day period prescribed by subdivision 3 of section 10 of the Court of Claims Act. It was not until August 13, 1976, more than two years after the accident, that a complaint was filed with the Clerk of the Court of Claims who treated it as a claim. Effective September 1, 1976 the provision of the Court of Claims Act governing filing of late claims (formerly § 10, subd 5) was renumbered and amended (L 1976, ch 280, § 2) to provide liberalized grounds for discretionary acceptance of late claims.
